A call to legalize and update an important Amazigh custom
A call to legalize and update an important Amazigh custom 11187
Until the 19th century, this custom was known and applied in Amazigh societies independent of the influence of the central Makhzen state. The time of its natural maturity has come, its time specified by the ruling authority, at the risk of the violator being subjected to a heavy fine called: “Tafcourt”.
As for the reason why I raised this call, it is that in recent years a corrupt and corrupting phenomenon has spread in our country, manifested in the flooding of markets and shops with aborted fruits, harvested and offered for sale before their natural ripening date.
And I think that there is no doubt about the corruption of this phenomenon, because it has been proven that it has multiple harms, given that its harm does not affect people’s health or taste only, because they eat fruits that are raw by nature, or that are forcibly ripe by artificial action, with evidence that the shops and sales carts have been filled for nearly two months with apparent grapes. Its corruption, from its color, shape and taste, on the grounds that the real time in which the ripening of this fruit is achieved, and therefore the possibility of offering it for sale is the month of August, I say that the harm is not limited to people’s health only, but also affects their pocket and budget, due to people’s rush because of the temptation to offer In the early days, to the acquisition of expensive fruits, as is fixed from the price of one kilogram, for example, of figs, whose price in the month of May, in which they appeared in the market, reached 50 dirhams, while its usual price is at the end of July and in August, which are considered the time of their natural ripening. , does not exceed 15 dirhams.
And if the responsibility for these damages - in this case - is distributed among the merchants on the one hand because of their early and hasty offering, and among the victims of this offer on the other hand, because of their lack of awareness of the natural ripening time of the fruits, then we should not forget that this phenomenon has another third harm, which affects a group of people. People aware of this time, who, because of this awareness, refrained from acquiring the offered fruits while waiting for their natural ripening time. Kings) for example, this year was missing from the market during its natural maturity, because it was harvested and sold before this time.
We should also not forget the harm that befalls the fruits themselves, given that harvesting them before they reach their natural maturity constitutes a miscarriage and, consequently, a blatant assault on them, which they cannot accept.
Therefore, there is no way to stop all these damages except by quoting our legislator of the aforementioned Amazigh custom rule, by issuing a law specifying the time allowed for the sale of fruits corresponding to the time of their natural ripening, with stipulating that the violator be punished with a deterrent financial penalty, up to the confiscation of the displayed product, and the closure of a store Selling in case of return.

Chapter 160 of the “Kasr Al-Kara” legislation states the following:
((Whoever picks up an olive for a yield, half of it (i.e. his punishment) is a riyal, and if he picks it up for a non-yield is half of it, a weight)
Chapter 195 of the same legislation states the following:
((As for the one who picks dates on the seventh of Pentecost, when the sheikh binds it, until it reaches ten days in September, its half is a Mithqal)).
